These Terms of Service ("Terms") are a binding agreement between you and Moto Maps ("we," "us," or "our") and govern your use of Moto Maps and the website at www.motomaps.co (the "Service"). Please read carefully: they include an arbitration agreement and class-action waiver (Section 16) and important disclaimers and limitations of liability (Sections 12–14). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to create an account or use the Service. You represent that you meet this requirement and have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind it.
The Service is a directory and community platform that lets users create profiles and listings (tracks, shops, riders, creators), post reviews, send messages, save listings, submit track suggestions, claim listings, and purchase subscriptions, passes, or featured placements. We may change features at any time. We host user-generated content and listings; we do not own, operate, inspect, endorse, or guarantee any track, shop, event, product, or service listed.
You are responsible for the information you provide, for keeping your credentials secure, and for all activity under your account. Notify us at motomaps.co@gmail.com of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
"User Content" means anything you submit, including profiles, listings, photos, videos, reviews, messages, track suggestions, and documents. You retain ownership. By submitting it, you grant Moto Maps a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, adapt, and distribute it for the purpose of operating, promoting, and improving the Service. This license ends when you delete the content or your account, except for content others have shared, backups retained for a reasonable period, and content we must keep to comply with law. You represent that you own or have rights to your User Content, that it does not infringe others' rights, and that it is accurate. We may, but need not, review, moderate, edit, or remove User Content at our discretion.
When you create or claim a listing, you represent that the information is accurate and that you are authorized to publish it. We may require verification and may approve, reject, or revoke listings and claims at our discretion. Community-submitted track suggestions enter a moderation queue and are not guaranteed to be published.
Reviews must reflect a genuine experience and must not be fraudulent, paid-for (unless disclosed and permitted), defamatory, or posted to manipulate ratings. We may remove reviews that violate these Terms. You are solely responsible for the content of your reviews and messages.
You agree not to: violate any law or the rights of others; post false, misleading, infringing, defamatory, harassing, hateful, or obscene content; impersonate others or misrepresent affiliation; submit fraudulent listings, claims, or reviews; scrape or harvest data except as permitted; upload malware or attempt unauthorized access; interfere with the Service or circumvent usage limits, paywalls, or security features; or send spam.
Where you buy determines who processes the payment. On the Moto Maps website, payments are processed by Stripe; by purchasing you also agree to Stripe's terms and authorize us (through Stripe) to charge your payment method for applicable fees and taxes. In the Moto Maps iOS app, all digital purchases — Moto Maps Pro subscriptions, the 7-Day Pass, and featured placements — are sold through Apple In-App Purchase and charged to your Apple Account. We never see or store your card details in either case. Prices in the app are set per App Store storefront and may differ from the prices shown on the website.
Subscriptions and auto-renewal: Moto Maps Pro is offered as a monthly or yearly subscription that renews automatically at the then-current price until you cancel. Payment is charged at confirmation of purchase, and each renewal is charged within 24 hours before the current period ends. Turning off auto-renewal at least 24 hours before the end of the current period stops the next charge; your access continues until the end of the period you have already paid for.
Cancelling: if you subscribed on the website, cancel from Settings → Billing. If you subscribed in the iOS app, your subscription is managed by Apple and must be cancelled in the App Store: on your device, open Settings → [your name] → Subscriptions, or App Store → Account → Subscriptions, and turn off auto-renewal for Moto Maps Pro. We cannot cancel or refund an App Store subscription on your behalf. Deleting your Moto Maps account does not cancel an App Store subscription — cancel it in the App Store as well.
Featured/promoted placements and the 7-Day Pass are one-time purchases sold for the scope and duration shown at checkout. They do not renew, and they are non-refundable once active.
Refunds: except where required by law or expressly stated, fees are non-refundable. Purchases made through the App Store are subject to Apple's refund policy, and refund requests for them must be made to Apple at reportaproblem.apple.com — we cannot issue refunds for App Store purchases. For purchases made on the website, contact us at motomaps.co@gmail.com.
We may change prices, applying changes to future billing cycles after reasonable notice. Purchases made through the App Store are additionally governed by Apple's Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula.
The Service itself — software, design, logos, and branding — is owned by Moto Maps or its licensors and protected by intellectual-property laws. These Terms grant no right to our trademarks or to copy or reverse-engineer the Service. All rights not expressly granted are reserved.
If you believe content infringes your copyright, send a notice with the required details to motomaps.co@gmail.com. We may remove allegedly infringing content and terminate repeat infringers.
The Service relies on and links to third-party services (Stripe, Apple, Mapbox, Cloudflare, Google, YouTube, and others). We are not responsible for them, and your use may be governed by their own terms.
Tracks, riding, racing, and related activities referenced on the Service are inherently dangerous and can result in serious injury or death. Moto Maps is a directory and does not operate, inspect, supervise, or control any track, facility, event, product, or activity listed, and does not verify the accuracy of listing details, rules, hours, pricing, waivers, age requirements, or safety conditions. You are solely responsible for evaluating any track, shop, event, product, or person you find through the Service, for complying with their rules and waivers, and for your own safety. To the fullest extent permitted by law, you assume all risk arising from your use of any listed track, facility, product, or activity, and you release Moto Maps from any related claims.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty about the accuracy, reliability, or availability of listings, reviews, locations, or other content. We do not warrant that the Service will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, Moto Maps and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or any personal injury or property damage arising from your use of the Service or any listed track, product, or activity, even if advised of the possibility. Our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) USD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Moto Maps and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.
Informal resolution: before starting a formal proceeding, contact motomaps.co@gmail.com and try to resolve the dispute informally for at least 30 days.
Binding arbitration: except as stated below, any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules, before a single arbitrator, rather than in court; judgment on the award may be entered in any court with jurisdiction.
Class-action waiver: you and Moto Maps agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding, and the arbitrator may not consolidate more than one person's claims.
Exceptions: either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court for intellectual-property infringement or unauthorized access.
Opt-out: you may opt out of this arbitration agreement by sending written notice to motomaps.co@gmail.com within 30 days of first accepting these Terms.
You may stop using the Service and delete your account at any time from Settings → Account → Delete account, without contacting us. Deleting your account removes your profile, listings, reviews, saved listings and personal history, releases any listings you had claimed, and cannot be undone. It does not cancel a subscription purchased through the App Store — cancel that in the App Store as described in Section 8. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or other users. Provisions that by their nature should survive termination (including content licenses already granted, disclaimers, limitations of liability, indemnification, and dispute resolution) will survive.
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Subject to Section 16, the courts located in St. Clair County, Michigan have exclusive jurisdiction over any matter not subject to arbitration.
We may update these Terms. For material changes we will update the "Last updated" date and provide notice where appropriate. Continued use after changes take effect means you accept the updated Terms.
These Terms are the entire agreement between you and Moto Maps regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
